Waste shipment in Germany and in Europe

1. In Europe

The following rules and regulations apply to the shipment of waste (export, import, transit):

  • Regulation (EC) Number 1013/2006 on shipments of waste
  • Commission Regulation (EC) Number 1418/2007 concerning the export for recovery of certain waste listed in Annex III or IIIA to Regulation (EC) Number 1013/2006 to certain non-OECD countries
  • Correspondents' Guidelines for Regulation (EC) Number 1013/2006
  • List of the custom offices designated for the entry of waste shipments into and their exit from the Community

2. In Germany

The following rules and regulations apply to the shipment of waste

  • Waste Shipment Act
  • Pertinent provisions of the Criminal Code
  • Ordinance on waste shipment fines
  • Ordinance governing fees associated with the Waste Shipment Act
  • Ordinance on the agreement of 20 January 2009 between the government of the Federal Republic of Germany and the government of the Republic of Austria on the transboundary shipment of waste pursuant to Article 30 of Regulation (EC) Number 1013/2006
  • List of the custom offices designated for the entry of waste shipments into and their exit from the Community
  • Bilateral agreement with Kosovo (KFOR/NATO) adopted pursuant to Article 11 of the Basel Convention and in force as of 15 February 2000

In addition, the Länder working group on waste (LAGA) drew up the following documents:

  • Guideline for the implementation of Regulation (EC) Number 1013/2006 and for the Waste Shipment Act (implementation guidelines for the shipment of waste)
  • Guidance on cooperation between customs authorities and waste authorities regarding the shipment of waste
  • Schedule of fines regarding violations against the rules and regulations on waste shipment
