First Ordinance amending the Biomass Ordinance entered into force

Biomasseheizkraftwerk The First Ordinance amending the Biomass Ordinance entered into force on 18 August 2005, one day after its promulgation in the Federal Law Gazette (BGBl. part I no. 49 of 17 August 2005, page 2419).

For fees to be paid under the Renewable Energy Sources Act (Article 8 – Fees paid for electricity produced from biomass) the Biomass Ordinance lays down which substances are recognised as biomass, which technical processes may be used for electricity generation and which environmental standards have to be met.

The Biomass Ordinance of 21 June 2001 has proven its worth in practice, which is also underlined by the positive development of electricity production from biomass. Changes in the legal situation regarding the disposal of animal by-products, however, made it necessary to adapt the provision relating to these substances in the Biomass Ordinance. The amendment only pertains to Article 3 (9) of the Biomass Ordinance. Up to now, this paragraph contained a reference to the Act on the Disposal of Carcasses, which has ceased to have effect. The definition of biomass properties of animal by-products is now based on the criteria set out in Regulation (EC) No. 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption. The recognition or non-recognition of certain animal by-products as biomass remains unchanged.

Ordinance on Generation of Electricity from Biomass (Biomass Ordinance – BiomasseV) of 21 June 2001

This Ordinance sets forth, for the scope of application of the Renewable Energy Sources Act, what substances shall be considered biomass, what technical processes for generating electricity from biomass fall within the Act's scope of application, and what environmental standards must be met in the generation of electricity from biomass.
